Terms of Service

These Terms of Service (“Terms”) govern your use of any courses, materials, websites, or services (collectively, the “Services”) provided by Cognus (“we,” “us,” or “our”). By purchasing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not purchase or access our Services.

Account Usage & Restrictions

  1. No Account Sharing: Accounts are intended for individual use only. You may not share your login credentials with others.
  2. No Unauthorized Reproduction or Distribution: You are strictly prohibited from copying, redistributing, republishing, or duplicating course materials—whether videos, documents, or other content—without prior written permission.
  3. No Recording or Pirating: You may not record, screenshot, or otherwise capture our content for any reason outside your personal study. Prohibited uses include, but are not limited to, distributing unauthorized copies or posting our content on third-party platforms.

License & Ownership Period

Course Access:

  1. When you purchase our on-demand courses, you receive a limited, non-exclusive, non-transferable license to access and view the course content through our Thinkific platform.
  2. Course ownership/access expires 365 days from the date of purchase, unless otherwise stated in a separate written agreement.

Refund Policy

Eligibility:

  1. Refund eligibility varies by course format (on-demand vs. live). For on-demand courses, refunds may be requested within 30 days of purchase if less than 10% of the course content has been accessed.
  2. Live training sessions are refundable only if you cancel 3 business days before the session start date. After that period, no refunds are granted.

Non-Refundable Circumstances:

  1. If you have accessed a significant portion of the course or have downloaded proprietary materials, refunds may be denied.
  2. Refund requests based on failure to meet hardware/software prerequisites do not qualify unless explicitly stated.

Process:

  1. Refund requests must be submitted in writing to support@cognus.co with proof of purchase and explanation.
  2. Approved refunds are processed within X business days to the original payment method.

Disclaimers & Limitation of Liability

No Guarantee of Results:

  1. We make no guarantee regarding your ability to pass any certifications, secure employment, or achieve particular financial or professional results from using our Services.

Use at Own Risk:

  1. You acknowledge that operating or programming real machinery carries inherent risks. Cognus is not liable for any damages, injuries, or losses arising from the application of GibbsCAM knowledge in any physical or commercial environment.
  2. You acknowledge that programming or running CNC machines using GibbsCAM involves advanced technical skill. By implementing techniques from our training, you assume all risks associated with equipment operation, including but not limited to setup, tooling, safety protocols, and maintenance.

No Commercial Use of Output:

  1. Our training and associated materials are for personal and professional development only.
  2. While you may apply course knowledge for personal projects or typical machine-shop operations, Cognus disclaims any liability for real-world commercial usage that might lead to machine damage, personal injury, or financial losses.

Limitation of Liability:

  1. To the fullest extent permitted by law, Cognus shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of the Services, even if advised of the possibility of such damages.

Governing Law & Disputes

1.     These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of laws principles.

  1. Any dispute arising under these Terms shall be resolved through binding arbitration in Vancouver, British Columbia, Canada in accordance with the rules of the ADR Institute of Canada (ADRIC), as administered by the ADR Institute of British Columbia (ADRBC). The arbitration shall be conducted in English, and each party shall bear its own costs unless the arbitrator decides otherwise.

Changes to Terms

1.     Cognus reserves the right to update these Terms at any time. The most current version will be posted on our website or Thinkific portal. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
